*** This job opportunity is not in the classified service and is not covered by the West Virginia Division of Personnel merit system. *** Under administrative direction, performs highly responsible legal work as the attorney and the chief legal officer to the Public Service Commission Chairman. Plans, assigns and directs the legal work of a staff of attorneys in the Office of General Counsel. Supervises and mentors, with assistance of the Associate General Counsel, a staff of attorneys. Performs highly responsible legal work in connection with public and private utility companies. Provides written and oral legal advice and opinion to the Commission in its deliberations and processes, and in other legal matters that might involve the Commission or its Commissioners; determines further appeal of contested cases and makes recommendations concerning final clearance. Provides legal representation of the Commission in various legal forums outside of the Commission, including state and federal court, legislative hearings and other federal and state agencies. Represents the agency in administrative hearings and appellate courts as well as state and federal courts and agencies. Reviews and analyzes proposed and enacted legislation, provides summaries of such analysis to the Commission, and when asked, participates in legislative hearings and discussions as a representative of the Commission. Provides oral and written opinions to other division directors, staff and outside counsel as needed. In addition to all case-related functions, the General Counsel fulfills many other ad hoc roles and activities as assigned or requested from time to time in the general administration and functioning of the Commission as an adviser to the Commission. Assists in formulating and drafting internal Commission policies and rules. Assists in formulating and drafting internal personnel policies and assists in the resolution of personnel conflicts. Reviews and approves a variety of contracts. Performs other related duties as required.

Responsibilities

Draft and advise on internal Commission policies, rules, and personnel policies; assist in resolving personnel conflicts. Review and approve contracts; fulfill other related duties as assigned.

Qualifications

Training:

Admission to practice law in the State of West Virginia. Experience:

Nine years of full-time or equivalent part-time paid experience in the practice of law, including trial experience in administrative or judicial proceedings. Substitution:

One year of full-time or equivalent part-time paid employment as an attorney with the agency to which assigned shall be considered the equivalent of two years of other qualifying experience. Note:

Salary

Special salary range for the Public Service Commission:

The Public Service Commission has established a salary range of $108,881 to $131,800 for this classification.
