Job Summary

As the State agency responsible for the administration of the Medicaid, the Children’s Health Insurance programs, and the behavioral health system, the Deputy General Counsel provides legal advice to the AHCCCS Administration regarding the AHCCCS Program and oversees the assigned reporting units, including attorney and administrative staff. The position may offer the ability to work remotely, within Arizona, based on department needs and performance. The State of Arizona promotes a work culture that affords flexibility, autonomy, and trust. Some State employees participate in the State’s Remote Work Program and may work remotely from home, in offices, or in hoteling spaces. All work should be performed within Arizona unless an exception is authorized in advance.

Responsibilities

Perform legal research, provide legal advice, and draft and prepare related legal documents arising from AHCCCS divisions regarding the AHCCCS Program, including compliance with state and federal law, the administrative dispute resolution process, provider enrollment and claim disputes, the Arizona State Plan and Section 1115 Demonstration, eligibility matters, third party liability, procurement issues, privacy laws, protection of the rights of persons with serious mental illness, and related matters. Supervise administrative and professional staff, including attorneys and paralegals, of reporting units; provide support, leadership, and foster continuous improvement within assigned units. Collaborate with OGC Leadership and AHCCCS Leadership on legal, administrative, policy, and programmatic matters. Supervise accuracy and timeliness of Director’s Decisions and prepare Director’s Decisions as needed. Review, negotiate, and prepare contracts and intergovernmental agreements; interpret contracts and advise on contract disputes and negotiations. Assist with oversight and drafting of administrative rules consistent with the Administrative Procedure Act, program requirements, and Agency objectives. Review proposed and current statutes, regulations, policy proposals, and other materials affecting the program; advise the Administration and other entities regarding potential impacts; collaborate with State and Federal entities, advocacy groups, law firms, and outside counsel as appropriate.

Selective Preference(s)

Arizona Driver’s License Minimum: Juris Doctorate from an accredited law school; admitted to the State Bar of Arizona and licensed to practice law in Arizona. Preferred: Five to seven years in health law, Medicare/Medicaid healthcare finance, or experience representing state or federal agencies; leadership of business, program, and operational units; two or more years of management experience supervising professional staff.

Pre-Employment Requirements

• Successfully pass fingerprint background check, prior employment verifications, and reference checks; employment is contingent upon completion of these processes. Travel may be required for State business. Employees who drive on state business must complete any required driver training. Retirement

Lifetime Pension Benefit Program administered through the Arizona State Retirement System (ASRS) with defined benefit; participation in Long-Term Disability and ASRS; pre-tax payroll contributions start after a 27-week waiting period. Deferred Retirement Compensation Program is optional and administered through Nationwide.
