Job Summary The Division of Office of the General Counsel (OGC) is looking for a highly motivated individual to join our team as an Associate General Counsel. This position works collaboratively to provide legal counsel and representation to clients within the Agency, including the AHCCCS Director, Deputy Directors, Assistant Directors, and other leadership and staff. The role may be performed from home in a Virtual Office (VO) setting or Telecommute based on unit needs and leadership discretion.

This position may offer the ability to work remotely, within Arizona, based upon the department's business needs and continual meeting of expected performance measures. Major duties and responsibilities

Perform legal research, provide legal advice, and prepare related legal documents regarding compliance with state and federal law and other authorities related to the administration of AHCCCS programs. This includes the public behavioral health delivery system, rights of persons with serious mental illness designations, FFP, managed care contracting, provider qualification and enrollment, provider reimbursement, beneficiary program eligibility, scope of covered physical and behavioral health services, third party liability and coordination of benefits, and the administrative hearing process for applicants, beneficiaries, providers and contractors.

Review and analyze current and proposed state and federal statutes and regulations, legislative proposals, sub-regulatory guidance, and case law applicable to the AHCCCS program; ensure compliance with privacy requirements and respond to public records requests and subpoenas accordingly.

Review Administrative Law Judge Recommended Decisions and assist with Director Decisions and Final Decisions.

Assist with the Office of Inspector General and other state/federal law enforcement entities on Medicaid fraud, waste and abuse; provide legal representation to the Agency in administrative and regulatory matters and support staff at administrative hearings.

Assist with drafting formal administrative rules consistent with program requirements, Agency objectives, and the Arizona Administrative Procedure Act.

Participate in negotiation, preparation and review of diverse contracts, including managed care contracts and intergovernmental agreements; ensure procurement compliance, interpret contracts, and advise on disputes, including protests. Assist with drafting and negotiation of the Medicaid State Plan and the Section 1115 Waiver documents.

Provide ongoing legal representation and support for staff at administrative hearings.

Review and analyze trusts related to applications for benefits for compliance with legal and program requirements, including approving or denying trusts under 42 U.S.C. 1396p, and overseeing trust reviews.

Knowledge, Skills & Abilities (KSAs) Knowledge:

Administrative hearing and rulemaking process; legal research methods; legal aspects of health care; managed care programs; entitlement programs (Title XIX/XXI); trust law; ethical standards for lawyers and public employees; public records laws; rulemaking; federal and state laws and regulations related to AHCCCS; administrative, contract and tort law; applicable court decisions and rules; HIPAA and 42 CFR Part 2; due process; experience applying state and federal law to trusts and eligibility.

Skill:

Writing and preparing complex documents; preparing pleadings, motions, discovery, affidavits; researching and applying information to complex issues; negotiation and interpersonal skills; organization; attention to detail; legal project management; computer skills (Microsoft Office, Google Suite); leadership and management abilities.

Ability:

Analyze and present legal positions clearly; synthesize complex issues; plan and prioritize multiple projects; communicate complex issues clearly in writing and verbally.

Qualifications Current Arizona Driver's License

Minimum:

Juris Doctorate from an accredited law school and the ability to maintain a current Arizona license within four months of hiring.

Preferred:

Minimum two years of experience in health law, Medicare/Medicaid healthcare finance, or experience representing state or federal agencies; leadership of business, program, and operational units of a large organization.
