Summary of Work
The individual in this position is responsible for conducting inspections throughout North Dakota of retailers and distributors licensed to sell tobacco products, to check for any contraband cigarettes, and gather information to be compiled to ensure compliance with applicable tobacco laws. This individual also is responsible for reviewing and comparing an assortment of reports and other submissions received regularly from tobacco product manufacturers, and distributors and creating and/or maintaining spreadsheets and other data summaries used to identify patterns and issues and to make appropriate recommendations. The individual in this position also will confer with other governmental agencies to obtain and share, as permitted, and evaluate data related to the enforcement of tobacco laws. The position is officed in Bismarck, with travel primarily throughout the state.
In addition to the monthly salary, this position includes fully paid health insurance for employee and family, the option to participate in employee-paid dental and vision for employee and family, participation in the state NDPERS defined contribution retirement plan as well as the option to participate in the 457 deferred compensation plan, the option to contribute to a medical spending account, and earning annual and sick leave.
Employees in this position are eligible for the Public Service Loan Forgiveness (PSLF) program.
Duties and Tasks Conduct inspections of tobacco product retailers and distributors, per investigative plans developed with tobacco team (currently an attorney and paralegal), designed to effectuate enforcement of range of tobacco laws. Conduct interviews of representatives of retailers or distributors in furtherance of inspections. Document during inspections tobacco products held by retailers or distributors, including checking for any contraband (off-directory tobacco products.) Communicate with tobacco team during inspections, as needed, to coordinate with law enforcement to facilitate seizure of any contraband. Review marketing advertisements and signage during inspections to check compliance with health provisions of tobacco Master Settlement Agreement and related laws. Complete checklists and other forms during inspections, documenting findings. Purchase cigarettes for fire-safety testing and review results of the testing. Scrutinize reports filed regularly by representatives of tobacco product manufacturers and distributors, following up with them as needed. Check reports for omissions or deficiencies and for any indication of contraband, following up with tobacco team and law enforcement as necessary. Tabulate large amounts of data from filed reports, including cigarette stick counts, to ensure compliance with broad range of reporting requirements. Analyze data from both inspections and reports filed with office to identify patterns and issues. Draw sound conclusions from analysis of data and make appropriate recommendations to tobacco team. Engage in communication with representatives of retailers and distributors, during inspections and from office, including to provide education and promote ongoing compliance with tobacco laws. Confer with officials from the North Dakota Tax Department and other state and federal agencies to obtain and share, as permitted, and evaluate relevant information, providing appropriate assistance. Develop and maintain good working relationships with representatives of tobacco product manufacturers, distributors, and retailers, and other agencies. Perform other related work including, as necessary, assisting tobacco team in possible litigation. Prepare spreadsheets, memoranda, notes, letters, and emails, as necessary, and assist with maintaining online tobacco files. Maintain proficiency in the use of office software including Microsoft Word, Adobe, Excel, and PowerPoint. Attend training, conferences, and meetings. Extensive (mostly in-state) travel, including overnight, with use of state vehicle. May involve some evening work.
Minimum Qualifications
Graduation from an accredited college or university with a bachelor's degree, or four years of experience of a kind resulting in relevant knowledge, skills, and/or abilities, as more fully delineated below. An acceptable combination of education and experience will be considered. Excellent report writing, communication skills, prioritization, time management, and organization skills. Ability to establish and maintain effective, harmonious working relationships with co-workers, supervisors, all agencies, and the public. Ability to maintain a high degree of confidentiality. Possess and maintain valid state issued driver's license. Must be at least 21 years of age at the time of application. Successful completion of the interview process, reference checks, and standard background and criminal record checks.
Preferred Knowledge, Skills, and Abilities General knowledge of financial and business record keeping, including computerized data records. Skill in constructing an organized and detailed account of financial transactions from records that can be disorganized. Skill in interpreting financial statements and other financial reports. Skill in preparing written reports and conducting interviews. Skill in oral communications. Skill in the use of software including Microsoft Word, Adobe, Excel, and PowerPoint.
