Under direction, the selected candidate interviews, advises, and represents clients in authorized criminal and civil cases; structures and directs investigations; prepares trials, pleadings, and motions; tries cases before court and jury; effectively presents sentencing and disposition positions on behalf of clients; and performs related duties as required. Distinguishing Characteristics
Deputy Public Defender III is a flexibly staffed level. Incumbents must have demonstrated competency in trial work by handling a major number of litigations and may represent clients in serious matters. Typical duties may include serious misdemeanor trials, major felony trials, juvenile court cases, or civil trials. Ideal Candidate
The ideal candidate will have knowledge of: The principles of criminal and civil law, criminal procedure, and trial practice The methods of legal research and writing Rules of evidence And the ability to: Gather and evaluate complex data and draw conclusions Read, interpret, and apply constitutional and statutory provisions Orally communicate complex information to diverse audiences Present persuasive arguments and conduct trials Interrogate and cross-examine witnesses Write clearly and organize material for court presentation Work independently and creatively; develop new methods to achieve results Use office computer and data systems Train, review, and supervise less experienced attorneys (some positions) Responsibilities (Examples of Duties)
Interview clients, advise on rights and options, structure investigations, review evidence, and prepare witnesses Conduct legal research and develop case strategies Prepare for trials, negotiate dispositions, appear in court, participate in jury selection, and present arguments Prepare petitions, briefs, motions, pleadings, and correspondence Employment Standards
Active membership in the State Bar of California and one of the following: Two years of progressively responsible experience as an attorney in public law, or four years as a general practitioner; OR One year of experience equivalent to Deputy Public Defender II with Santa Barbara County; OR A combination of training, education, and experience equivalent to the above Knowledge of: Criminal and civil law, legal research methods, California and U.S. constitutions, evidence rules, and trial procedures Abilities: Perform legal research, apply precedents, and present clear arguments Represent diverse clients, maintain confidentiality, manage a caseload Interview witnesses, negotiate settlements, and conduct trials Desirable Qualifications: Bilingual fluency in English and Spanish and/or Mixteco is desirable. Applicants must self-certify language proficiency on the application; higher fluency may be tested. Supplemental Information
