Senior Counsel, Labor & Employment This position will be located at Guaranteed Rate’s offices at 3940 N. Ravenswood, Chicago, IL 60613 (remote/hybrid). For California candidates, the position is fully remote. Guaranteed Rate is building a winning team to reinvent the mortgage experience through innovation, technology and a relentless focus on providing industry-leading mortgage products and superlative customer service. You will provide practical labor & employment advice to business clients and pursue and defend labor & employment claims through negotiation, arbitration or litigation. Responsibilities
Litigation: Defend the company in employment and related claims, including in arbitration and in response to administrative claims and inquiries from governmental agencies; handle attorney letters and claims. Litigation: Serve as first or second chair in single plaintiff employment matters handled in-house by the company. Litigation: Manage discovery, draft pleadings and motions, conduct depositions, prepare witnesses for trial, and lead factual and legal investigations. Litigation: Engage and manage outside counsel for required expertise and more complex employment litigation matters. Litigation: Assist with other litigation matters, including restrictive covenant and commercial litigation matters. Litigation: Draft and respond to cease and desist letters and demand letters. Litigation: Handle other legal matters as assigned by management. Advice and Counsel: Provide timely, practical, and business-oriented legal advice on a range of employment issues, including hiring, performance management, employee relations, policies and handbooks, leaves of absence and accommodations, discrimination and harassment, wage and hour, internal investigations, discipline, termination, compensation, and benefits. Advice and Counsel: Research, review and counsel HR and management on handling employee relations matters, including ADA, FMLA, FLSA, NLRA, and employment discrimination. Advice and Counsel: Support HR with draft employment and separation agreements. Advice and Counsel: Develop, draft and implement workplace policies, employee training, and related templates and agreements cross departmentally. Advice and Counsel: Update Legal, HR and management on changes in the law at state and local levels that impact operations. Advice and Counsel: Lead and collaborate with cross-functional partners on complex projects to sustain employment law compliance across multiple jurisdictions. Advice and Counsel: Advise on employment and dispute provisions in commercial agreements and mergers & acquisitions (M&A). Advice and Counsel: Conduct internal audits to support compliance, such as classification reviews and management of leaves of absence. Advice and Counsel: Participate in the development of training materials regarding labor and employment laws in collaboration with Human Resources, among others. Experience/Qualifications/Skills
7+ years of labor and employment litigation experience, including the ability to handle matters independently with minimal oversight. Working knowledge of federal and state employment laws and regulations (including ADA, ADEA, FLSA, FMLA, Title VII, etc.). Strong persuasive writing and clear oral and written communication skills. Interest in and understanding of emerging state-law trends including equal pay and pay transparency legislation, arbitration agreements and restrictive covenants, state wage and hour laws, etc. Positive, team-first attitude and a can-do, roll-up-your-sleeves mindset. Sound business judgment with the ability to balance legal risks and business goals. Ability to explain legal risks clearly to business partners and deliver solution-oriented advice. Willingness to learn the business and build strong relationships with internal stakeholders. Detail-oriented with excellent organizational skills; ability to work constructively and cross-functionally. J.D. degree from an ABA-approved law school; licensed to practice law. Compensation and Benefits This job will remain posted for 30 days. Pay range - $210,000 - $225,000.
