JOB SUMMARY:
Lead our U.S. export compliance and DG/HazMat compliance programs. This role owns and drives policies, risk controls, licensing/classification, screening, investigations, training, and stakeholder engagement across air, ocean, and ground. You will also oversee DG/HazMat and operations compliance training, and partner closely with commercial teams and customers. Additionally, you will own ITAR/Defense compliance and DDTC engagement across defense contracts and customers, including registration, licensing and agreements, technology control plans, and interaction with U.S. Government stakeholders.
DUTIES:
Build and maintain an effective EAR/OFAC/CBP compliance framework; monitor and implement updates to BIS rules, including China-related controls (e.g., Entity List, MEU/MEU rule, advanced computing/semiconductor rules, military/intelligence end‑use/end‑user, 744 series).
Lead classification (ECCN/HTS), license determinations, use of license exceptions (where applicable), and documentation of NLR determinations.
Oversee restricted party/end‑use/end‑user screening and escalation, including attestation/End‑Use Statements.
Guide customers on routing, licensing feasibility, and sanctions/supply chain alternatives; maintain clear decision records and audit trails.
Partner with operations to embed controls in TMS/WMS/ERP and screening tools; perform periodic transaction testing.
Own DG/HazMat programs under IATA DGR/ICAO TI, and FAA/TSA requirements.
Maintain company‑wide training matrix, records, and instructor qualifications.
Conduct internal audits of DG acceptance, documentation, packaging/marking/labeling, and incident reporting; drive corrective/preventive actions.
Defense/ITAR & DDTC Engagement
Own the company’s ITAR compliance program and integrate it with EAR/OFAC controls across air, ocean, and ground operations.
Manage DDTC registrations and renewals (e.g., manufacturer/exporter and, if applicable, broker) and administer DECCS user access and governance.
Prepare, submit, track, and manage ITAR authorizations: export/import licenses (e.g., DSP-5, DSP-73, DSP-61), Technical Assistance Agreements (TAA), Manufacturing License Agreements (MLA), amendments, proviso implementations, Commodity Jurisdiction (CJ) requests, and General Correspondence.
Support the Empowered Official (EO): certify submissions, ensure eligibility, maintain EO procedures, and safeguard certification integrity.
Design and enforce Technology Control Plans (TCPs), including physical/IT controls, visitor management, foreign national access controls, and project‑level handling of technical data and defense services.
Lead defense customer/contract compliance: review and implement ITAR and DFARS flow‑downs, support DCS and FMS shipments/programs, manage consignee/end‑use/end‑user vetting, and monitor third‑country transfers and reexports.
Oversee brokering compliance where applicable (ITAR Part 129), including registration determinations and activity reviews.
Coordinate shipment execution to satisfy license/exemption terms, AES filings (correct license/exemption codes), proviso compliance, hand‑carry/temporary exports/returns, and documentation alignment across routing, airway bills, and commercial invoices.
Conduct internal ITAR audits, transaction testing, and recordkeeping per regulatory requirements; remediate gaps with corrective/preventive actions.
Act as primary point of contact with DDTC for applications, inquiries, proviso clarifications, directed disclosures, and voluntary disclosures; coordinate with BIS/OFAC/CBP as needed on multi‑regime matters.
Commercial Customer Interactions
Be a visible compliance advisor in pre‑sales and customer reviews, technology controls, DG shipments, and cargo security.
Conduct onboarding risk assessments, compliance clauses, End‑Use Statements, and tailored SOPs; deliver customer training and QBRs.
Support RFPs/RFQs, customer audits, and corrective action plans.
Governance, Training, and Continuous Improvement
Publish policies, SOPs, job aids, and desk‑level procedures for stations and gateways.
Run a risk‑based audit plan (U.S. stations/partners), track KPIs, and report to leadership.
Own compliance systems and data integrity (screening, license workflows, training LMS, audit tools).
Demonstrated ITAR experience: DDTC registration management, DECCS administration, and drafting/submitting ITAR licenses (DSP-5/61/73/94), TAAs/MLAs, amendments, CJs, and proviso implementation.
Experience supporting defense customers and programs (DCS/FMS), including contract flow‑downs, consignee/end‑use controls, and execution under ITAR/EAR.
QUALIFICATIONS:
8–12+ years in export/trade compliance within freight forwarding, integrators, or global logistics; significant hands‑on experience with China‑related controls and screenings a plus.
Expert in EAR and BIS licensing/classification, with strong working knowledge of OFAC, CBP, TSA, PHMSA, IATA DGR, IMDG, and CTPAT.
Demonstrated ITAR experience: DDTC registration management, DECCS administration, and drafting/submitting ITAR licenses (DSP-5/61/73/94), TAAs/MLAs, amendments, CJs, and proviso implementation.
Experience supporting defense customers and programs (DCS/FMS), including contract flow‑downs, consignee/end‑use controls, and execution under ITAR/EAR.
Demonstrated track record drafting/submitting VSDs (BIS/OFAC; CBP PDs) and managing investigations/CAPA.
DG/HazMat training leadership; ability to design and deliver function‑specific curricula and recurrent programs.
Strong stakeholder skills: partner with sales, operations, gateways, and customers; clear, concise writing for policies, advisories, and disclosures.
Bachelor’s degree or 10+ years of related experience, advanced degree a plus.
Certifications preferred: CUSECO/CES (ECTI), IATA DGR, CCS/CCS (NCBFAA) or equivalent.
