CHARACTERISTICS OF THE CLASS: Under the supervision of the City Manager, the City Attorney serves as the chief legal officer for the City. This position is responsible for providing legal counsel to the Mayor, Board of Commissioners, City Manager, and other City officials on matters related to their official duties and the interests of the City. The City Attorney is appointed by the Mayor and Board of Commissioners. DUTIES AND RESPONSIBILITIES: 1. Provide legal advice and representation as assigned by the Mayor, Board of Commissioners, and/or City Manager. 2. Attend all regular and special-called meetings of the Board of Commissioners, offering legal guidance in person or remotely as needed. 3. Provides legal assistance to certain boards and commissions appointed by the Mayor and/or City Commissioners including the Ethics Board, Code Enforcement Board, Board of Adjustments, Planning & Zoning Boards, Architectural Review Board and acts as the City’s prosecutor when requested before the boards; may occasionally be asked to provide limited legal advice to other city boards and commissions. 4. Represents the City or supervises the representation of the City in all judicial and administrative proceedings in which the City or any of its officers or certain boards or committees may be party or have an interest. 5. Assists the City Manager and Human Resources Director in personnel matters and represents the Board of Commissioners when holding personnel disciplinary hearings. 6. Conduct legal analysis, research, and preparation of pleadings; participate in depositions, hearings, court conferences, trials, and appellate proceedings. 7. Draft, review, and interpret City ordinances, policies, and other legal documents to ensure compliance with applicable laws and regulations. 8. Assists in the negotiation of contracts and drafts and reviews as to form and sufficiency all legal documents, contracts, deeds, and proposed municipal orders and ordinances, as well as ordinance summaries as required by state statutes. 9. Assists in the negotiation of property acquisitions and dispositions and processes real estate transactions, including the preparation of title opinions and real estate closings. 10. Handles or supervises all civil litigation involving the City, including but not limited to condemnation, damage claims, civil rights and contracts. 11. Advise City officials and departments on legal matters, risk management, and regulatory compliance. 12. Collects through litigation, if necessary, delinquent property tax accounts, assists the Department of Finance in collecting delinquent net profit and occupational fees and assists them by filing code enforcement liens and by collecting code enforcement fines and charges. 13. Collaborate with external legal counsel when necessary and manage litigation strategies in the City’s best interest. 14. Serve as the ABC administrator for the city. Manage compliance with state law and local ordinances related to alcoholic beverages, including the prosecution of local enforcement actions as requested. 15. The responsibilities of the City Attorney are not limited to the above and may have other duties assigned. TRAINING, EDUCATION & EXPERIENCE: Must possess and maintain a valid KY driver’s license. Requires a bachelor’s degree, and a law degree from an accredited college or university; license; and ten years’ experience as an attorney, with at least five years’ experience in a municipal setting. Must be licensed to practice law in Kentucky or able to immediately become licensed. Must be admitted to practice in federal court. SPECIAL KNOWLEDGE, SKILLS AND ABILITIES: Comprehensive knowledge of municipal law, including Kentucky Revised Statutes (KRS) related to the city’s classification. Strong understanding of City operations, administration, and governance, including ordinances, orders, and personnel policies. Ability to analyze and interpret complex legal issues and provide sound legal advice. Excellent written and verbal communication skills. Ability to effectively advocate for the City in legal proceedings and negotiations. Seniority level
