Salary B22: $5,100.00 per month; B24: $6,142.00 – $6,300.00 per month.

About the Agency The Texas Department of Agriculture (TDA) Legal Services Division Enforcement Section investigates violations of state and federal pesticide, herbicide, Right‑to‑Know laws and regulations, consumer laws and programs, plant quality, seed quality, weights and measures, commodity warehouses, egg quality, and the Agricultural Protective Act.
Responsibilities
Plan and organize legal services; interpret laws and regulations; prepare legal opinions, briefs and notices of violation; provide legal advice and counsel to client agencies; handle public calls and consult trial attorneys.
Represent the agency at administrative hearings; process public information requests; assist with appeals.
Prosecute assigned cases involving TDA regulatory functions: review cases informally and formally; draft and issue notices of violation; draft pleadings and discovery documents; file proposed findings of fact and conclusions of law; represent agency before Administrative Law Judges; negotiate settlements; coordinate with TDA staff and other state agencies or private parties.
Provide formal and informal legal advice to assigned programs; review and draft contracts, correspondence, forms, penalty schedules, regulations, proposed legislation; prepare training materials and presentations; handle requests under the Texas Public Information Act; prepare statistical information for reporting purposes; follow safety guidelines and perform other duties as assigned.
Qualifications
J.D. or B.L. degree from an accredited four‑year college or university; license to practice law in Texas.
For Attorney I: Educational background or work experience performing legal research and preparing briefs or memorandum of law.
For Attorney II: Work experience as a licensed attorney analyzing legal problems, preparing sound opinions and interpreting laws and/or regulations; experience preparing and litigating cases in civil or criminal trials or administrative hearings; experience performing legal research and preparing briefs.
Preferred Qualifications Employment or clerkship with a governmental agency or prosecutor’s office, in an administrative enforcement division.
Knowledge, Skills, Abilities
Knowledge of legal principles, practices, and proceedings.
Skill in legal research, writing, and analysis; proficiency with computer and applicable software; reasoning and logic; prioritizing workloads; using judgment.
Ability to conduct hearings, prepare opinions and briefs, prepare cases for trial, conduct research, summarize findings, interpret and apply laws, use legal reference materials, communicate effectively both orally and in writing; exercise sound judgment and discretion; maintain confidentiality.
Physical Requirements Normal office work environment. May involve walking; standing; pulling and pushing; kneeling, stooping and bending; performing tasks requiring fine motor skills and coordination; safely lifting up to 30 pounds. Must be able to work extended periods at a computer and may require working evenings and weekends.
Working Conditions Mostly sedentary in nature; may involve dust and environmental allergens. The role typically involves extended computer use and occasional long shifts.
